1. Acceptance of Terms

By accessing or using BonsaiHub ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years of age to use BonsaiHub. If you are between 13 and 16 years of age, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these age requirements.

3. User Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering. You agree to notify us immediately of any unauthorized use of your account.

4. User Content & Licensing

You retain ownership of all content you submit to BonsaiHub, including photos, journal entries, tree records, and other materials ("User Content"). By submitting User Content, you grant BonsaiHub a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

This license continues until you delete your content or your account, at which point we will cease displaying it within a reasonable timeframe, except where copies are retained in backups or as required by law.

You represent that you have the right to submit any content you upload and that it does not infringe on the intellectual property rights of others. For details on copyright complaints, see our Community Guidelines.

5. Acceptable Use

You agree not to use BonsaiHub to:

• Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any person or entity, or falsely represent your affiliation with a person or entity.
• Upload content that infringes on any patent, trademark, trade secret, copyright, or other intellectual property right.
• Distribute spam, chain letters, or unsolicited commercial communications.
• Attempt to gain unauthorized access to other accounts, computer systems, or networks connected to the Service.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use automated means to access or scrape the Service without permission.
• Violate any applicable local, national, or international law or regulation.

6. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or our Community Guidelines. Upon termination:

• Your right to access and use the Service will immediately cease.
• We may delete your account data in accordance with our Privacy Policy.
• You may request an export of your data prior to termination by contacting us.

You may also delete your account at any time through your account settings.

7. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by BonsaiHub Contributors and is protected by copyright and other intellectual property laws. The BonsaiHub name, logo, and branding are trademarks of the project.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, BonsaiHub Contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of the jurisdiction where the Service operator resides.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

11. Changes to Terms

We may revise these Terms at any time by posting the updated version on this page. Material changes will be communicated through the Service or via email. Your continued use of BonsaiHub after changes take effect constitutes acceptance of the revised Terms.
